General terms and conditions
Article I – Purpose
I-1 : These General Terms and Conditions of Sale apply to all professional training courses, whether Inter-company or Intra-company, organised by IFC TRITECH. Any registration for a training course implies unreserved acceptance of these GCS.
Article II – Order of training
II-1 : Registration for an Inter-company training session or a professional training request for an Intra-company training session must be formalised by a written confirmation sent by post or electronically by the applicant Company, either by means of a training agreement, a registration form or an official order form.
It is the customer’s responsibility to ensure that the trainees’ pre-requisites match the programme.
IFC TRITECH provides the customer with resources to assess the prerequisites.
II-2 : The application must include :
- The title of the training course and its reference,
- The dates of the chosen session,
- The surname(s) and first name(s) of the participant(s),
- Precise contact details for the applicant company (address, telephone, fax, SIRET number, etc.),
- The recipient of the invoice and their contact details,
- The address to which the invitation is sent, if different from that of the invoice recipient.
II-3 : If the company applies to its OPCO for funding for its training course, the application must be accompanied by the agreement of the organisation managing the company’s training funds in order to be taken into account.
Payment by the OPCO can be made by cheque or bank transfer.
II-4 : If, for any reason whatsoever, the body managing the training funds refuses to cover the costs of the training course, the company is responsible for paying them.
Article III – Invitation – Supporting documents
III-1 : For inter-company training courses, a personal invitation is sent to the applicant company approximately three weeks before the start of the course. It is up to the employer to pass on these details to the participant(s). If specifically indicated at the time of registration, the invitation can be sent directly to the participant.
III-2 : Intra-company training course invitations can be sent to the company’s address if requested.
III-3 : At the end of the training session, the supporting documents (attendance certificate, attendance sheet, satisfaction questionnaire, etc.) are sent to the company or to the training fund manager.
The end-of-course certificate is sent directly to the trainee.
Article IV – Prices
IV-1 : The price of the training courses, excluding tax, is that shown in the contract in force at the time of registration.
VAT is payable by the customer, at the rate in force at the time of payment.
IV-2 : The price of the inter-company course includes :
- Teaching costs,
- Documentation given to each participant,
- An after-sales service, linked to training.
The price of the inter-company course does not include accommodation and living expenses for the participant.
The price of the Intra-company training course includes (unless otherwise stipulated in the price offer) :
- Preparing and running the module,
- Travel, accommodation and living expenses for the presenter for a training course in mainland France,
- Course materials will be provided for each participant,
- Post-training technical assistance is provided to trainees in connection with the training.
IV-3 : The documentation provided to participants is for their exclusive use only. Reproduction is prohibited.
Article V – Postponement – Cancellation
V-1 : IFC TRITECH reserves the right to postpone or cancel a training session if the minimum number of enrolments required is not met or in the event of force majeure due to unforeseeable, uncontrollable or external events.
In this case, it informs the company as soon as possible.
IFC TRITECH will postpone the Intra-company session, depending on availability, to a date chosen by the client company or the Inter-company registration to a future session. The company may not claim any compensation for any reason whatsoever as a result of the cancellation or postponement of a training session.
V-2 : IFC TRITECH must be notified as soon as possible of any cancellation of a training session by the company, or any total or partial absence of a participant from an inter-company training session, and will be invoiced as follows :

Article VI – Terms of payment
VI-1 : Invoices are payable on receipt, with a due date of 30 days of the invoice date. There is no discount for early payment.
For all international courses, a 50% deposit is required on signing the agreement or order.
The balance is payable on receipt of the invoice, with a due date of 30 days of the invoice date. There is no discount for early payment.
Article VII – Late payment
VII-1 : In accordance with article L441-6 of the French Commercial Code, any delay in payment will give rise to the following charges from the first day the payment is overdue :
- Interest on arrears equal to the most recent refinancing rate of the European Central Bank plus ten points (Law on the Modernisation of the Economy – LME – No. 2008-776 of 4 August 2008);
- To the application of a flat-rate indemnity for collection costs of €40 (European Directive 2011/7 of 16 February 2011, Law 2012-387 of 22 March 2012, and Decree 2012-1115 of 2 October 2012);
- Where the collection costs incurred exceed the amount of this flat-rate indemnity, additional compensation may be paid, subject to proof.
Article VIII – Settlement of disputes
VIII-1 : In the event of a dispute regarding the execution of a training course, IFC TRITECH and the customer undertake to seek an amicable settlement. Failing agreement, the Roanne court will have sole jurisdiction to settle the dispute.
Article IX – Confidentiality of documents
IX-1 : Documents and media supplied by customers to IFC TRITECH remain the property of the customer. The data contained in these media and documents is strictly covered by professional secrecy. IFC TRITECH undertakes to take all necessary precautions to protect the security of information and in particular to prevent it from being distorted, damaged or communicated to unauthorised persons.
IFC TRITECH is the designer of the proposal and the proposed programme. Clients undertake not to distribute the documents and media provided by IFC TRITECH during the training course. The data contained in these media and documents are the exclusive property of IFC TRITECH, the only party authorised to reproduce and distribute them.
Any abuse will be punished and governed by the provisions of the Act of 11 March 1957, as amended by the Act of 1 July 1992.
Article X – Personal data – GDPR
X-1 : The information collected as part of the training is processed in accordance with current regulations on the protection of personal data. Participants have the right to access, rectify and object to any data concerning them.
